Welcome to Birdcall! These Terms of Service ("Terms") govern your access to and use of Birdcall’s website, mobile application, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. About Birdcall

Birdcall provides on-demand access to autonomous drone services and missions through a network of available drone docks. Our Services allow individuals and businesses to request aerial data and insights for use cases such as inspections, monitoring, 3D modeling, and more.

2. Eligibility

You must be at least 18 years old to use Birdcall.

You represent and warrant that you have the authority to enter into these Terms and that you are not prohibited by applicable law from using the Services.

3. Accounts

To access certain features, you must create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate and up-to-date information when creating an account.

4. Use of Services

You may only use the Services for lawful purposes.

You may not interfere with the operation of our drones, docks, software, or networks.

Birdcall reserves the right to deny or terminate access to the Services at any time for violation of these Terms.

5. Drone Missions

Missions may be subject to availability, weather, airspace restrictions, and regulatory approval.

Birdcall does not guarantee mission completion in all circumstances.

You agree not to misuse drone data or deploy drones for unlawful or unsafe activities.

6. Payments & Pricing

Fees for Services will be displayed before you confirm a booking.

All payments are due at the time of booking, unless otherwise agreed.

Subscriptions or enterprise plans may have separate terms.

7. Data & Content

Drone-collected data (e.g., photos, videos, 3D models) will be made available to you as part of your mission.

You retain rights to the data collected from missions you request, subject to Birdcall’s license to use anonymized or aggregated data to improve Services.

You may not resell or redistribute Birdcall data without permission.

8. Safety & Compliance

Birdcall operates drones in compliance with FAA regulations and other applicable laws.

You must not request missions that violate laws, trespass on private property without authorization, or endanger people or property.

Birdcall reserves the right to cancel or deny missions for safety reasons.

9. Intellectual Property

Birdcall and its licensors retain all rights in the Services, software, branding, and associated intellectual property.

You may not copy, modify, distribute, or reverse-engineer any part of the Services.

10. Termination

You may stop using the Services at any time.

Birdcall may suspend or terminate your access if you violate these Terms.

Upon termination, certain provisions (such as payment obligations, disclaimers, and limitations of liability) will survive.

11. Disclaimers

The Services are provided “as is” and “as available.”

Birdcall makes no guarantees about uptime, data accuracy, or mission availability.

To the fullest extent permitted by law, Birdcall disclaims all warranties, express or implied.

12. Limitation of Liability

To the maximum extent permitted by law, Birdcall is not liable for indirect, incidental, special, or consequential damages.

Birdcall’s total liability arising out of or relating to the Services is limited to the amount you paid for the Services giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Birdcall, its affiliates, and employees from any claims, damages, liabilities, or expenses arising out of your use of the Services or violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles.

Any disputes will be resolved through binding arbitration in Seattle, WA, except where prohibited by law.

15. Changes to Terms

Birdcall may update these Terms from time to time. We will notify you of significant changes by posting them on our website or app. Continued use of the Services after changes means you accept the new Terms.
